Quickset Kyle Asphalt Paving provides asphalt paving, sealcoating, repair, resurfacing, and related services for residential and commercial customers in Kyle, Texas and the surrounding region. Specific services available are described on our website and confirmed in writing at the time of estimate.
All services are subject to availability, site conditions, weather, and other factors outside our control. We reserve the right to decline any project at our sole discretion.
All estimates are provided in writing and are based on the information available at the time of the site visit. Estimates are valid for 30 days from the date of issue unless otherwise stated. An estimate is not a guaranteed final price - the final cost may change if the scope of work changes after the estimate is issued, or if unforeseen site conditions are discovered during the job.
We will notify you of any material change to the estimated cost before proceeding with additional work. Verbal quotes are not binding. Only written, signed estimates or contracts represent a commitment to a specific scope of work and price.
Prices on our website, if any, are for general informational purposes only and do not constitute a binding offer. Project-specific pricing depends on site conditions, material costs, and other factors that require an in-person assessment.
Work dates are scheduled by mutual agreement and confirmed in writing. We may need to reschedule due to weather, material availability, crew scheduling, or other circumstances. We will notify you as soon as practicable if rescheduling is necessary.
If you need to cancel or reschedule a scheduled job, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in a fee to cover mobilization costs already incurred, as specified in your service agreement.
Work that is cancelled after materials have been ordered or delivered may be subject to material restocking or disposal fees, which will be itemized and communicated to you in writing.
Payment terms are specified in your written service agreement or invoice. Unless otherwise agreed in writing, payment in full is due upon completion of the work. For larger commercial projects, we may require a deposit before work begins, as outlined in the project agreement.
Accepted payment methods will be communicated at the time of estimate. Invoices not paid within the agreed timeframe may be subject to a late fee as specified in the invoice or service agreement.
We reserve the right to suspend or halt work on a project where payment obligations from a prior phase have not been met.
Any workmanship warranty we provide will be described specifically in your written service agreement. Where a warranty is provided, it covers defects in materials and workmanship under normal use conditions. It does not cover damage caused by:

To the fullest extent permitted by applicable law, Quickset Kyle Asphalt Paving will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our website or our services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of a specific service project will not exceed the total amount paid by you for that project. This limitation applies regardless of the legal theory on which the claim is based.

If you have a concern or complaint about our services, we encourage you to contact us first so we can try to resolve it directly. Most issues can be addressed quickly through direct communication.
If a dispute cannot be resolved through direct communication, the parties agree to attempt good-faith mediation before pursuing litigation. Any unresolved disputes will be subject to binding arbitration under the rules of a mutually agreed arbitration body, or - if arbitration is not agreed upon - will be resolved in a court of competent jurisdiction in Hays County, Texas.
You agree that any claim arising from these Terms or our services must be brought within one year of the date the claim arose, to the extent permitted by applicable law.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal proceedings arising from these Terms or our services will be brought in the appropriate courts of Hays County, Texas, and you consent to the personal jurisdiction of those courts.
We reserve the right to modify these Terms at any time. Changes become effective when posted to this page with an updated effective date. We will not notify you individually when changes are made, so please review these Terms periodically. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
